1. Acceptance of Terms
By creating a Fondly account or using the Fondly app, you agree to be bound by these Terms of Service, our Privacy Policy, and our Community Guidelines. If you do not agree to these terms, do not use Fondly.
2. Eligibility
You must be at least 18 years old to use Fondly. By using the app, you represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are not prohibited from using the service under any applicable law.
You may only maintain one Fondly account. Creating multiple accounts may result in permanent suspension of all accounts.
3. Your Account
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information during registration and to update it as necessary.
Fondly reserves the right to suspend or terminate accounts that contain false information, impersonate others, or violate these terms.
4. Community Guidelines
You agree to treat other users with respect and not to:
• Harass, threaten, intimidate, or bully other users
• Share sexually explicit content, nudity, or pornography
• Use the platform for commercial solicitation or advertising
• Impersonate another person or create fake profiles
• Engage in scamming, catfishing, or fraudulent behaviour
• Share other users' personal information without consent
• Use automated tools, bots, or scrapers on the platform
• Promote violence, hate speech, or discrimination
• Solicit money or financial information from other users
Violation of these guidelines will result in account suspension or permanent ban at Fondly's discretion.
5. Content You Create
You retain ownership of content you upload to Fondly (photos, bio text, messages). By uploading content, you grant Fondly a non-exclusive, worldwide, royalty-free licence to use, display, and distribute your content solely for the purpose of operating and promoting the Fondly service.
You represent that you own all content you upload and that it does not infringe upon the rights of any third party. Fondly may remove content that violates these terms without prior notice.
6. Matching & Interactions
Fondly's AI matching system suggests potential matches based on your preferences, profile information, and compatibility analysis. We do not guarantee that you will find a match or that interactions will lead to a relationship.
Fondly is not responsible for the conduct of any user, whether online or offline. Users interact entirely at their own risk. Fondly does not conduct criminal background checks on its users and does not verify the statements made by users. You are solely responsible for your interactions with other users.
Safety recommendations:
• Always meet in a public place for the first time
• Inform a friend or family member of your plans (who, where, when)
• Do not share financial information, home address, or workplace location early
• Trust your instincts — if something feels wrong, leave and report the user
• Never send money to someone you haven't met in person
• Video call before meeting in person to confirm identity
If you experience any criminal conduct from another user, contact your local law enforcement immediately. Fondly will cooperate fully with law enforcement authorities upon receipt of valid legal process (court orders, subpoenas, or lawful government requests).
7. Memberships & Payments
Fondly offers paid memberships (Spark, Aura, Elite & Black) and Fond Message packs, available through Google Play Billing. Prices are shown in your local currency where supported, and otherwise in US Dollars (USD).
Membership subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions any time from your Google Play account. Refunds are handled in accordance with applicable consumer protection laws and the policies of our payment processor (Google Play).
Fond Message packs are non-refundable once a message has been successfully delivered to the recipient. Unused text credits do not expire.
8. Photo Verification
Fondly uses photo verification technology to help ensure users are authentic. Verified profiles receive a verification badge. Attempting to circumvent verification (using others' photos, screenshots, or manipulated images) will result in account termination.
9. Intellectual Property
The Fondly name, logo, app design, AI matching algorithms, and all related intellectual property are owned by Fondly and protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Fondly platform without written permission.
10. Disclaimer of Warranties
Fondly is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. We are not responsible for any damage resulting from your use of the service, including but not limited to emotional distress from interactions with other users.
11. Limitation of Liability
To the maximum extent permitted by law, Fondly shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or other intangible losses, resulting from your use of or inability to use the service.
Our total liability for any claims related to the service shall not exceed the amount you paid to Fondly in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Fondly, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the service, your violation of these terms, or your violation of any rights of another user or third party.
13. Termination
You may delete your account at any time. Fondly may suspend or terminate your account at any time for violation of these terms, upon receiving verified reports of harmful behaviour, or if required by law.
Upon termination, your right to use the service ceases immediately. Provisions that by their nature should survive termination shall survive (including Sections 10, 11, and 12).
14. Governing Law & Jurisdiction
If you reside in India, these terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra, India.
If you reside in the European Union or European Economic Area, these terms are governed by the laws of your country of residence. You may bring proceedings in the courts of your country of residence. Nothing in these terms affects your rights as a consumer under mandatory local law.
If you reside in the United States, these terms are governed by the laws of the State of Delaware, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that you may bring claims in small claims court if eligible.
If you reside in the United Kingdom, these terms are governed by the laws of England and Wales. You may bring proceedings in the courts of England and Wales, or in the courts of your country of residence.
For all other countries, these terms are governed by the laws of the State of Delaware, United States, and disputes shall be resolved through binding arbitration — unless your local consumer protection laws grant you stronger rights, in which case those rights are preserved.
15. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of material changes through the app or via email. Your continued use of Fondly after changes become effective constitutes acceptance of the new terms.
